As of August 1, 2023, the U.S. Citizenship and Immigration Services (USCIS) has released a new version of Form I-9.

Key Points:

  • New Form I-9: Starting on November 1, 2023, employers are mandated to exclusively use this new version for verifying the identity and employment authorization of all individuals they hire.
  • Expiration of Previous Form: The previous version of Form I-9, dated “10/19/2019,” was allowed for use until October 31, 2023. After this date, continued use of the expired form will result in non-compliance with federal employment eligibility verification requirements.
  • Remote Document Verification: Employers enrolled and participating in E-Verify now have the option to examine eligibility verification documents remotely. However, specific steps must be followed to continue to use this option after flexibilities provided during COVID-19 have expired.
  • Verification in Puerto Rico: The revised Spanish version of Form I-9 is available for use in Puerto Rico only.
